01 Open checkbook
Will you publish a searchable online record of the Office of the Attorney General's own expenditures — vendor, amount, and date — updated at least monthly?
02 Procurement sunlight
Will you, as Attorney General, decline to approve as to legality any contract or amendment above $25,000 whose solicitation, bid abstract, award decision, and contract were not posted online within 15 days of execution?
The law already requires all contracts to be registered with the Department of Administration. See Guam Code Annotated Title 5 GCA § 22602. I would work with DOA to make this database electronically and publicly accessible.
03 Sole-source accountability
Will you support a public quarterly report listing every sole-source and emergency procurement, the justification invoked, and the approving official, by name of office?
04 FOIA performance
Will you commit the Office of the Attorney General to meet the response deadlines of the Sunshine Reform Act of 1999, and publish your office's annual response-time performance?
05 Auditor independence
Will you commit to acting on every Office of Public Accountability audit referral within your legal authority — pursuing enforcement or prosecution where the findings support it — and reporting publicly on the disposition of each?
The Office of Public Accountability possesses its own, independent authority to impose correct action plans. In most cases, the OPA should enforce these plans itself (currently, it doesn’t). The Attorney General should enforce and prosecute when civil or criminal liability is imposed by law on government officials, employees, or contractors.
06 Audit findings have deadlines
Will you require the Office of the Attorney General to publish a corrective-action plan, with named owners and dates, within 90 days of any OPA audit finding concerning your office — and report publicly on completion?
The current Public Auditor often imposes policy preferences during the audit process. These are not appropriate topics for corrective action plans. As Attorney General, I will ensure audit findings and management responses are posted online. If a CAP is legally justified, I will make compliance and enforcement plans publicly available.
07 Merit in hiring
Will you publish the position description, minimum qualifications, and basis of selection for every appointed position in the Office of the Attorney General?
08 Open meetings
Will you require every board or commission within the Attorney General's authority to post agendas, minutes, and recordings as the Open Government Law contemplates — and support real consequences for bodies that do not?
Statement
As a public servant for the majority of my legal career, I commend Klaru and Mr. Kim for the commitment to transparency and accountability. I agree with the principles laid out in each question, but in some instances the questions over-simplify the legal issues identified in each inquiry. In these instances, I was compelled to provide a few qualified answers, ensuring precision.
In other instances, I do not believe the commitments go far enough. For example, the Attorney General must, as the law requires, publish the position description, minimum qualifications, and basis of selection for every appointed position in the office. But, the Attorney General should also take appropriate enforcement action when other government agencies fail to fully follow these (and other) open government and transparency mandates.
Ultimately, the Attorney General as the Chief Legal Officer of the government of Guam is responsible for championing the Rule of Law.
